Please read these Terms of Service carefully before using Que'd ("Service"), operated by Que'd ("we," "us," or "our") at qued.tv. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using Que'd in any way, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Que'd is a media tracking platform that allows users to log, organize, and share media they have watched or plan to watch, including movies, television shows, and other content. The Service may include social features such as friend connections, recommendations, and shared lists.

3. User Accounts

You may register using Google authentication. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts at our discretion.

4. User Content

4.1 Your Content

You retain ownership of any content you submit to the Service, including lists, ratings, reviews, and recommendations ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating the Service.

4.2 Prohibited Content

You agree not to post content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable. We reserve the right to remove any content that violates these Terms without notice.

5. Acceptable Use

You agree not to: (a) use the Service for any illegal purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) scrape, crawl, or systematically harvest data from the Service; (d) use automated bots or scripts to interact with the Service; (e) impersonate another person or entity; or (f) interfere with the Service's normal operation.

6. Third-Party Content and Services

The Service may display information about movies, television shows, and other media sourced from third-party APIs and databases. We do not claim ownership of this content and make no representations about its accuracy or completeness. Links to third-party sites are provided for convenience and do not constitute endorsement.

7. Intellectual Property

All trademarks, logos, and service marks displayed on the Service are the property of Que'd Social, LLC or their respective owners. Nothing in these Terms grants you any right to use them without prior written consent.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Que'd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Que'd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Sections 7 through 13 shall survive termination.

12. Governing Law

These Terms are governed by the laws of the State of Kentucky, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Kentucky, and you consent to personal jurisdiction in those courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date above. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
